Oh, don't worry, I already have you in my sights for that "pad sale thread".

      As an aside...

It's not the I'm "sue-happy" (or maybe I am), but the OP was wronged. He provided a service at an agreed upon price.

He fulfilled his end of the bargain and it bothers me (on principle) that this guy won't pay. So, frankly that amount of money is of no consequence to me, but the principle is worth pursuing.

Put another way, if you walk into a store and take something without paying, we call it theft and it can land you in the sin-bin. Yet guys like this slug, just think they can ignore you.... well, homey don't play that.

Let me have a look at the small claims complaint before you start the action. I might be able to help you.

I've noticed in our court system here in rural No. California, the burden of proof is to prove that you did the service and did not get paid for the service.

Bring with you date and time you did the detail, any phone records (cell phones are great for every detailed call), what products you used etc. Before and after pictures would help especially with a time stamp on the picture.

The site 3Fitty gave you is a good site, it has the forms needed for small claims in California as well as any other court action.

            California Courts: Forms

SC-150 is the directions of some sort....

I'm not sure on the forms you need to fill out. I was a Court Bailiff, so....I just listened and made faces at people like 3fitty (those attorneys I was friends with at least).

I'm sure when he is served with a summons of some type, he may come clean. I suggest also, that you keep your court date then dismiss without predjudice if he pays. I say this because if he pays you and the funding is not there (check) you can re-open case. Dismiss the case with predjudice you cannot, unless I got it backwards, been a while. 3Fitty may chime in .

No small claims expert Nappers, but it sounds pretty spot-on to me. Good advice!
