  • Speeding ticket 2day!!! Hep!!!

    I totally messed up 2day and got a ticket ! I was driving today down 1-20 E going from GA to NC to see my mom in NC. I got pulled over for doing 89mph in a 70mph zone. I kno i messed up! what do i do! im going to college in 5 months and im poor! give me tips and advice please! omg! and pray!

    Sometimes if you are proactive, if this is your first offense. You may be allowed to take a defensive driving course. This negates the points on your record. As long as you are citation free for specified period of time.

    I would call and see if you have any options.

      Not to sound like a parent, but you could SLOW down, drive safely and take other people's lives into consideration! I would suggest to try for a defensive driving course also, but whether it's your first offense or not, they may not see too far past such a high rate of speed.
      There's no reason to become alarmed, and we hope you'll enjoy the rest of your flight. By the way, is there anyone on board who knows how to fly a plane?

          Sometimes if you take it to court, you have the option to pay the ticket amount but to Charity, that way you pay your debt and NO points go against your record. Not sure of the state you got your ticket in but thats how it works here!

            Thinking I would probably hire a lawyer. It might be expensive, but over the long haul you will save money on your insurance if you can get away with no points. Insurance companies don't take kindly to people getting tickets for speeding 19 over.

                Speaking for California.....

                Our state if you take it to trial and the cop can't make it, the court will ask you to continue it and if you object, they dismiss it. CA does a trial by declaration and a judge determines your guilt (declaration, write a letter and the cop does too).

                You could show up, plead guilty, throw yourself on the mercy on the court and ask for traffic school and in CA at least, traffic school doesn't allow the points to your record, thus your insurance doesn't find out.

                In CA traffic school cost's money and extra money to the court and with our jurisdiction, the fines have to be paid up front before traffic school. You also may want to check out community service to help pay the fine, seen as your in college, your local college may be on a list for community service.

                Give them a call and see what your options are.

                AND SLOW DOWN!

                Of all the training I went to the last 16 years for our department, I could scare the lead foot out of you with all of the carnage I saw on tape from people going to fast and getting in an accident. If someone is killed, it's Vehicular Manslaughter and looking at major time in the klink for that, or if they are just injured, Assault with a Deadly Weapon (car) and could face major time for that.

                Plus, your billfold won't be so empty putting gas in your car because your going to fast. I can't remember what the distance is but going 15 miles over the speed limit for I think 60 miles or whatever, saves you 5 minutes.....Only.

                    That is a bummer....

                    If you have to go to court, HIRE an attorney.

                    You are young and the judge may see that act as a recognition that you are taking this serious. He will be more likely to cut you a break, especially because the judges tend to know the attorneys. And more important, the attorneys know the judges and the system. Part of what you spend in attorney fees will probably be off set by a smaller fine.

                    Showing up by yourself could prompt the judge to "teach you a lesson".

                    BTW - The cop may have cut you a little break by not writing the ticket at 90mph, 20 miles over. If an attorney can get your speed dropped to 74mph you may get away with no points and only a fine.

                    Georgia Drivers License-Georgia Ticket

                    Georgia Traffic Courts are not the friendliest places to spend your time. Most of the clerks of court are not helpful if you can even get them on the phone. In most states you first continuance is almost automatic but most Georgia courts require some type of evidence that you cannot appear.
                    Your first appearance is just an arraignment and the officer may or may not be there. The judge will allow you to enter a plea and pay your fine so take cash since they will not accept a check. Most courts will offer to reduce your speed by 3 to 5 mph in return for a guilty plea. This is important since a 14mph or under speeeding ticket will not be posted to your record and not increase your insurance premiums.

                    Traffic school or a deferment are not options to keep the ticket off your record in Georgia. You do have the option, with the judge's approval, once every five years of entering a plea of Nolo. If your record is clean it makes no sense to plead Nolo. Nolo will still show up on your record as a conviction with just no points. If you have a clean record you can stand to absorb 3 points (max of 15 every 2 years in Ga) and save your nolo plea for sometime in the future if you really need it, like in an accident.

                    If you intend to contest your speeding ticket then see if you can enter a plea of not guilty by mail or fax. Always mail any legal document certified return receipt. then check with the court to be sure it has been received. This needs to be done at least two weeks prior to your court date. This keeps you from wasting a day at the arraignment.

                    The fines for a speeding ticket in Georgia are usually between $145 and $325 dollars. The clerk of court can tell you what to expect for your particular citation.

                    Georgia Drivers License Point system

                    Violations of Georgia driving law will result in points being assessed to your driving record as shown below:
                    Violation / Points
                    • Reckless Driving - 4 points
                    • Unlawful passing school bus - 6 points
                    • Improper passing on hill or curve - 4 points
                    • Speeding:
                    • 15 mph but less than 19 mph - 2 points
                    • 19 mph but less than 24 mph - 3 points
                    • 24 mph but less than 34 mph - 4 points
                    • 34 mph or more - 6 points
                    • Disobedience of any traffic-control device or traffic officer - 3 points
                    • Possessing an open container of an alcoholic beverage while driving - 2 points
                    • Failure to adequately secure a load - 2 points
                    • All other moving violations - 3 points
                    • Child restraint - 1st offense - 1 point
                    • Child restraint - 2nd and subsequent offense - 2 points
                    • Aggressive driving (A conviction of aggressive driving by a person under 21 years of age will result in a suspension of the driver's license.) - 6 points
                    • HOV lane violation - 4th and subsequent offense. - 1 point

                    Under 21 Years of Age Suspension

                    The Georgia driver's license of any person under 21 years of age convicted of any of the following offenses shall be SUSPENDED:
                    • Hit and run or leaving the scene of an accident in violation of Code Section 4-6-270.
                    • Racing on highways or streets.
                    • Using a motor vehicle in fleeing or attempting to elude an officer.
                    • Reckless driving.
                    • Any offense for which four or more points are assessable under subsection (c) of Code Section 40-5-57.
                    • *Unlawful passing of a school bus.
                    • *Improper passing on a hill or curve.
                    • *Exceeding the speed limit by 24 miles per hour or more.
                    • Purchasing an alcoholic beverage.
                    • Driving under the Influence.
                    • Aggressive Driving, Code Section 40-6-397.
                    • Misrepresenting age ot identity for purpose of illegally obtaining any alcoholic beverage
                    • The driver's license of any person under 18 years of age who has accumulated a violation point count of four or more points within any 12 month period.

                          Do you have a choice or must you go to court? On minor violations you can often pay the fine by mail and avoid a court appearance. In doing so you are pleading guilty to the ticket and would get all the points, etc... The wording on the ticket should tell you if this is an option.

                          My guess is that it is not and at 89 mph you are REQUIRED to go to court.

                          I don't think you want to be standing in front of a judge by yourself at 17 with a ticket for 89 mph.

                          Still think you need an attorney.

                          No idea but probably not.

                          A guess - Modifying the charges, the ticket, is probably a power only the judge can exercise.

                            See if there is a thing called court supervision or something similar. I know it's quite popular for new drivers in Illinois who get a ticket. They pay a little bit more money, and if you go 6 months without another infraction, the whole incident is wiped clean, but you get one shot for your entire life for court supervision.

                              I have always heard that Georgia was tough. Never knew that traffic school was not a option. Thanks for passing along that valuable info.
