  • Was this legal?? Please help!!

    Two university staff members (20 years of age) knocked on my door. They heard music and people talking inside. More voices than usual. I walked outside and shut the door behind me. They then asked to come in several times and I denied them access. They called university police, I also denied them access to the room as well. They didnt care and came in anyways.....

    Per the rules to below and to YOUR understanding, WAS THIS LEGAL?

    3. INSPECTION, SEARCH, AND SEIZURE
    Students are guaranteed the rights of any citizen and therefore will not be subject to
    unreasonable searches and seizures.
    The courts, however, have recognized the right of the
    University to conduct reasonable inspections, searches and seizures in order to enforce University
    regulations. Georgia Southern University reserves the right to conduct such inspections, searches
    and seizures within limits of the law.
    INSPECTIONS
    (1) The University reserves the right to inspect rooms for possible damage, health and safety concerns.
    The University reserves the right to enter rooms or other facilities at reasonable hours.
    (2) The University reserves the right to enter rooms or other facilities at any time it has reason to suspect
    a violation of University regulations is occurring.
    SEARCH
    (1) The University reserves the right to conduct searches of individual rooms and lockers in a residence
    hall or other facility on the campus if there is reason to believe that a University regulation has been
    violated.
    (2) Law enforcement officials may search facilities with or without authorization from the University by
    means of a search warrant.
    (3) Efforts will be made to have the student available when a facility is searched.
    (4) Evidence seized during a search can be used in disciplinary procedures concerning a violation of
    University regulations.
    (5) In addition to the above, the University reserves the right to conduct searches of individual rooms and
    lockers in a residence hall or other facility on the campus if a University official determines there is an
    emergency.
    Room Search Procedure/Guidelines
    (1) The need for a search must be established by a University Staff Member (suspicion of drugs,
    weapons, fireworks, stolen items, etc.).
    (2) When the need for a search is established, the University Police are contacted.
    (3) If the University Police establish the need for a search, they will talk with the students and request the
    evidence (drugs, weapons, fireworks, etc.) be turned in to them immediately. If the University Police
    determine that a search is warranted, they will request consent from the student to search the room. If
    the student denies the request, the University Police may request legal authorization to conduct a
    search or University officials may seek approval to search from the Dean of Students or his/her
    designee.

    (4) If consent to search the room is granted by the student, the University Police will conduct the room
    search. A report will be filed with the Office of Judicial Affairs.
    (5) If the search produces evidence that constitutes a felony, the student will be arrested. If the search
    produces evidence that is not considered to be a felony, it will be the judgment of the University Police
    to file charges and send a report to the Office of Judicial Affairs.
    (6) If consent to search a room is not granted by the student, the University Police may request a search
    warrant (see other option in #7). If a warrant is granted by judicial order, the University Police will
    search the room. A report will be filed with the Office of Judicial Affairs. If the search produces
    evidence that constitutes a violation of law, the student may be arrested.

    (7) If consent to search a room is not granted by the student, University Housing Staff Members may
    request permission to search a room from the Dean of Students or his/her designee.
    (8) If permission to search a room is authorized by the Dean of Students or his/her designee, a
    room search will be conducted and a report will be filed with the Office of Judicial Affairs. During a
    2009-2010 Georgia Southern University Student Code of Conduct p. 24
    search authorized by the Dean of Students or his/her designee, the University Police will remain
    outside the room.

    Were you give a reason for the "inspection"?

    Had they received a complaint?

    Who were the first two? Security?

      No. I was told they hear some music and a lot of people. Was I having a party. The first two ppl asked me this and they are students who help monitor resident halls. Called "community leaders"...the only reason they called university police is because I denied them entry...

      No, they did NOT recieve any type of complaint. The heard music and more voices that normal. They took it upon themselves to investigate...

      The officer obtained evidence while he was in my dorm. I think it can be thrown out because I think he entered unlawfuly??

        Are you worried because the officer did something "unlawful" or because you were involved in something unlawful? I have the weird feeling that the whole story is not being told here.

          No. The whole story is being told. In short. 2 girls knocked at my door. I went outside to speak to them. They said they heard some noise. Is anyone inside consumed alcohol. I said yes, I have a 21 yr old here. They then id him and get his info. They asked to come in to make sure underaged ppl wernt drinking. I told them no, and asked everyone to leave while they could. I think waited for the officer to arrive. I told the cop he was not allowed inside and i would speak with him if need be in the hallway....he said no and came inside. He ten told me his name and that it is better to cooperate. I said sure....
          "can i request officer &@$@( to be present" ..
          Cop - "no you may not, she is not working tonite"...ok

          Cop - "will you take a portable breath test"
          Me - "what is your policy if i dont"? "do you take me to your station or to the county station"?
          Cop - didnt really know what to say. never answered the question...?

          He TO MY UNDERSTANDING did not have permission to enter...???

            Hmmmmmmm........I would say that he never searched your room did he? Or did he just swing by to inspect?

            Depending on how it happened and how they choose to define the event will change whether its legal.

            The police reserved the right to inspect any room at any time for any reason they feel is pertinent and that was in what you originally posted.

            The long and short of it is that you may have been busted only if you were participating in illegal activities. Did you have reason not to take a breath test?

              While in no position to offer legal advice, I was a "community leader" decades ago. The university I attended and worked had a pretty broad definition of reasonable inspections. Folks living in residence halls had signed a contract stating they and their guests would not violate university regulations. Suspicions of same would allow reasonable inspections, unannounced and unplanned. Again, decades ago...

              Right now you feel violated, but you've not been charged nor received anything in writing indicating wrong doing. "Governments of the Student Body" often have offices to assist their peers in matters such as this. Somewhere in your student handbook will be some information.

                Did anything more come of the matter? If so, it might be wise to seek legal counsel. If not I would just let it go. No need to start trouble if it is not necessary. In other words, just because you have a match doesn't automatically give you the right to start a fire.

                  Agreed. If I were the officer in question, and I asked if you would be willing to submit to a breathalyzer test (having good reason to ask) and you refused, I would suspect you were trying to hide something. But that's just me.

                    Not hiding, just excerising my legal rights. Im a criminal justice major. lol. Wanting to be a LEO...just tryinf to excerise what I kno...

                    The housing contract I signed states:

                    "Right of Entry
                    The University reserves the right to enter the studnet's room to inspect, verify occupancy, make improvements or repairs, claim University property, or control the room in the event of an epidemic or emergency, or for any other purpose related to the proper maintenance or operation of the residence halls."

                      Cliff Notes version: You had a mix of under 21 and over 21 people in your room. Alcohol was there (which by the way is more than enough probable cause for a search of your room with a group of mixed age people). More noise than usual was made and got the community leaders' attention. You didn't comply with their request to go inside your room and told your guests to leave. Campus PD was called. Again, you didn't comply with their request to go inside your room and chose not to take a breathalyzer. They took "evidence".

                      The officer was right - you're better off cooperating. You look guilty/suspicious whether you did anything illegal or not.

                      Welcome to live in the dorms - play by the rules and it can be a good time. Don't play by the rules and you likely won't live there very long. You're a freshman right? You've got a long way to go in your college career. Residence staff and campus police have been around the block and have seen it all. Trying the "exercising my rights" line is going to make life harder for you and could result in tougher penalties than simply cooperating and being up-front and honest with them especially if you don't have anything to hide as you claim.

                      Underage drinking is a huge problem on college campuses across the country and the schools will do what they can to curtail it - especially in the wake of student deaths related to alcohol on other campuses. If you go through all of the paperwork related to your dorm agreement, student handbook / code of conduct, etc. I bet there is a statement somewhere that they don't need your permission nor do you need to be present for campus police to enter.

                        I once put swirls in my paint just to see what it looked like.

                        I don't always detail cars, but when I do, I prefer Meguiar's.

                            For an INSPECTION....evidence was seized which then makes this case a SEARCH. I dont believe evidence can be take and used in the judicial process from an "inspection"....they are there to "inspect" not "collect"...

                              The way I see it more than likely had you cooperated with the "advisors" they never would have called the P.D. and eveything would have been fine. I'm sure due to probable alcohol consumption ones judgement may have been affeccted leading to you "exercising" your rights in a less than respectful manner. Thats why they called the P.D.

                              As far as the search and siezure part im no expert in the University aspect but i can tlel you the policy is written so it can be very loosely interpreted and applied to a variety of circumstances.

                              As far as the norm for search and siezure you have to ask is:
                              1-Does the officer have a legal reason for being there?
                              2-ONce there can he articulate enough reasonable suspicion to say that a crime has occurred, is occurring or about to occurrand that the person or persons there are conneccted with the crime.

                              Its just like if an officer walks up to your door and see through an open window a pile of cocaine on the table. At that point he can now make entry and sieze the contraband/evidence. Becasue its in "plain view" and he has a legal reason for being there.

                              Now lets say you have a 6 foot high fence and the officer looks over your fence and sees the same thing. Probably not as rock solid becasue he has no legal reason to be looking ovcer the fence. Unless of course he is there for lets say a loud music complaint and no one answers the door so now he is trying to contact the homeowner to veryfy everything is ok and investigate the noise complaiont.

                              Im going to say that in this case and i mean no offennse you were probably a little mouthy to the advisors and the officer. ANd once he smells alcohol know ing your a fershmen well now he has established reasonable suspicion and your reluctance to let them in and hearing voices and wanting to investigate the possibility of underage alcohol has further established probale cause to enter your room without a warrant and then one in sieze evidence related to a crime.

                              I'm guessing when first confronted if you had taken the apporach of "I'm very sorry, ill turn the usic down and send everyone home" you would not be having this discussion.
