The person driving. It's not the cell phone. It's not the passengers. It's the person driving it who needs to be able to deal with distractions, etc. If the person driving is using a cell phone, they need to be able to handle it. The cell phone is not causing the accident. I use my cell phone regularly in my car because I spend hours a day driving and have things that I have to take care of during "business hours," i.e. - when I am driving most of the time. I have not been in any accident while driving or received a violation of any kind, especially one cause by an inanimate object such as a cell phone. I do not consider myself lucky about the above one bit. I know that I am able to handle using my phone while driving.
