  • My first car accident... and it was a lame one.

    I was always taught to go big or go home. So when it comes to car accidents, I always want to either crush the opponent's vehicle or have mine torn to pieces, you know, makes things more interesting (just kidding). This past Thursday, I got into my first car accident...

    For those who don't live in Jersey, Thursday had some periods of intense rain, all the cars were doing 20 on streets with speed limit 40, and it was really scary. I had just dropped a friend off at a local train station. Since it was pouring at that time, I didn't park in the parking lot and have my friend walk to the building and get all soaked, so I parked on the side of the street (legally, there are parking spots there). Friend got off the car, we said our goodbyes, all is well. All of a sudden, I turn away from my friend and look forward, and I see this car coming towards me, and it hits me head on. Keep in mind, it wasn't somebody trying to parallel park and scraped my car, nor was it somebody trying to pull some cool car stunt like those in movies... I was parked on the opposite side of the street (the street had 2 lanes going each way with an extra "lane" for parking on each side), and got hit head on, bumper to bumper...

    Can it get more ridiculous? Yes. Got out to talk to the driver, and got her information... The car she was driving was not even hers. It was her mother's. It wasn't even her mother's, it was her mother's rental. And according to her driver's license, she's not at the legal age to rent cars yet. She says she doesn't want to report to insurance company (I wouldn't either if I was her), and we got each other's info and we'll see how this is gonna turn out.

      Oh, no! Not the CTS!

      I don't know how things work around New Jersey, but people outside of NJ always have different opinions about the authorities in that area. In most other places, people would have reported this to the police. The reason is that the minor you encountered was literally driving illegally in a rental car. Although you may not have the right to citizen arrest the other driver, it was probably to the best of your interest to report her action. I don't know. I am only into contract laws. I am not into traffic regulations.

      I can see that one of the troubles you will face in regards to this incident is that you are parking oppositely to the flow of traffic. I am not sure if that is legal in your area, but I believe in most cities that is a traffic violation. You may see an insurance increase if you report this incident to the insurance companies, claiming that you parked opposite to the flow of traffic. I have heard that when people crash into cars parked in the wrong direction, the driver could claim that he/she was blinded by the oncoming headlights, thereby releasing him/herself of any legal responsibility.

      I don't know. Hope things turn out okay for you.

          You got this wrong, I wasn't parked opposite to the traffic flow... I parked on the most right hand side of the street, she crossed the double yellow line and hit my car. That's the outrageous part.

            Please tell me you got a police report with her statement of liability noted in the report. It could get tricky later if she decides to recant and present a different story, especially since she's a minor.

                  I believe you have to be a certain age to rent a car, not drive a rented car. Let's hope they splurged for the $4 extra protection insurance with the rental.

                    Sorry to hear about this. That is incredible how she hit you. I would at the very least call the police non emergency number, and ask some general questions. It may shed some light on any options you might have. Glad no one was hurt.

                      Yeaup, there's a police report, she just begged not to report to insurance.

                          Not so much... Her eyes were so big they were out of proportion with her face. And if she hits a car parked on the opposite side of the street, I doubt you can teach her any driving skills
