I dont think you would have to worry about infringing on someone elses company. Theirs tons of small business' across the country that have the same or similar names.
Unless of course you decide to call your company something like Maguiars or something like that.

You have to file for a DBA, you can get in SERIOUS trouble if you are doing business under someone else's buisness name.

LOL, yea...if your name or DBA is exactly the same as a business located close to yours.
But if you name your business Joe Shmoe's Detailing and you operate out of Burlington, VT and theirs also a shop called Joe Shmoe's Detailing in Detroit Michigan....youre not going to get in any trouble.

When you start a business you will have to file for a fictitious name at your local City Hall, if the name that you are trying to do business under is in use you will have to pick another name.

That being said, many business' use the exact same name. Basically as long as your not using the same name in order to confuse the consumer you should be good.

Almost forgot, this is based on my knowledge of California small business and when dealing with a Limited Liability Company (LLC) and large corporations the laws differ.

So, I would do a few online searches for the exact name your looking to use and if you don't find anything in your area or a large company, head on over to City Hall and file for a Ficticious Name. Also I would recommend having a good business plan, and research local steps needed to start your business, there are quite a few time limits once you get the ball rolling. You don't want to get started and not know your next step.

                            Gook luck
