    I'm amazed that the State of California finally clamped down. Is Jay Leno next? (Just how do you license a jet powered motorcycle or a 1000 hp Toronado built on a C5 Corvette chassis in California, anyway?)



    Monster fine for 'Monster Garage'
    Show creator Jesse James is dinged nearly $300,000 for smog violations.

    With creations like the "Undertaker" and "666 El Diablo," Jesse James and his West Coast Choppers team have become TV stars and automotive icons by turning average motorcycles into pimped-up machines.

    But California air regulators announced Friday a $271,250 fine against James, the co-producer and host of "Monster Garage" and "Motorcycle Mania," saying that 50 of his custom-built choppers ran afoul of California's clean-air rules.

    California Air Resources Board officials said their inspectors found that the monster bikes sold between 1998 and 2005 did not have state certified emissions equipment on their exhaust and fuel systems.

    As a result, bikes were spewing hydrocarbons at up to 10 times the state limits, said Paul Jacobs, chief of the board's Mobile Sources Enforcement branch.

    The market for custom-built motorcycles has taken off in recent years as celebrities, athletes and other gilded age luminaries plunk down $50,000 - and far more - for signature rides.

    James, who is married to actress Sandra Bullock, could not be reached for comment. Nobody who answered the phone at his Long Beach-based West Coast Choppers would discuss the state action.

    Regulators said James' celebrity status was not the reason he was targeted. Souping up motorcycles has become a huge industry, and the state has cited, sued or settled air pollution cases with more than 20 motorcycle customizers, Jacobs said.

    In addition, the National Highway Traffic Safety Administration has fined other auto customizers - including the similarly named but unrelated West Coast Customs, which was then affiliated with the MTV show "Pimp My Ride" - for allegedly replacing steering wheel air bags with TV monitors.

    Despite James' maverick image, his hamburger joint next to the bike shop is promoted as environmentally friendly, including using solar energy.

    Cisco Burgers' website says: "We use biodegradable paper products, natural, no preservative meats, organic dairy and produce."

    While I have watched the show, Mr. James knows the California requirements and if he knowingly violated those regulations then there is a price that he will have to pay. For those who have breathing issues, elevated levels of hydrocarbons on a hot summer day make it very difficult to take a breath.

    The fact the ‘hamburger joint’ next door pushes the point that they are environmentally friendly is not pertinent to this discussion as grilled meat and paper towels have nothing to do with the allegations of excessive amounts of air pollutants produces by the choppers created and sold by Mr. James.

    Mr. James is an artist and his work is fantastic but if he broke the rules then he needs to pay the piper.

        I'm glad they caught up with the guy. When I was in California, I couldn't even put a performance air intake on my car. If the rest of us were building and selling non-compliant vehicles, we would have been busted years ago.

          A common mistake that people make when trying to design something completely foolproof is to underestimate the ingenuity of complete fools.

            I'm sure he will just pay it as fighting it will cost him much more. That much money probably equates to $100 or so to the average joe.

              It's one thing for Jay Leno, or any of the rest of us, to build or modify a vehicle for our own use - the thing will still, somewhere along the line, have to pass the state emissions test. But when you're building a vehicle with the intent to sell it, wouldn't that vehicle be immediately subject to DMV registration and, hence, have to immediately pass the state emissions test? If not, why not? If so, then how where all of Jesse's customers passing said test? Or were they all rogues, riding around on unlicensed bikes (which I highly doubt, of course)?

                That is a great question. how are these people getting their bikes to pass the current regulations ?

                    You would think the government would crack down where it would make a difference, like diesel engined vehicles.

                    Those custom choppers are ridden so few miles that the emissions from them are insignificant.

                      the 1000 hp Toronado should be only. GM sold him an engine and all he did was put turbos on it. The part where he street raced another car in it wasn't so legal. But Jay has a new car every wheel if they fined him $1M it is still small change to him

                        Have you seen the current regulations for diesel engines????

                        The point here is that well known people seem to get around the rules. If you built a custom bike in California, you would be caught right away. Yet it took years for the State to catch up with Boyd Coddington, Jesse James and a few others.

                        People have circumvented the regs for years. A while back, a company called Titles Unlimited in Alabama was busted by the California Attorney General's Office. Alabama is a "stated title" state. That means youy can fill out a registration application and simply state what kind of car you have. Kit car builders in California would hire TU as their agent and have the company register their new Cobra replica by proxy in Alabama as a "1965 Ford Convertible".

                        The registration and plates would be mailed to the builder in California, who would present them to the California DMV, which at the time HAD to accept an out of state registration and issue a California one. Not being satisfied with just lying about what kind of car he was registering, the builder would normally put $1,500 as the value of his "1965 Ford Convertible" when in fact a Shelby CSX4000 replica or a Kirkham replica can easily be worth over $125,000.

                        My guess is the buyers of these custom bikes or hot rods register them out of state. Arizona is very easy on home built or kit vehicles, as is Wyoming (no smog checks up here, either). The buyers probably get caught when they try reregistering in California.

                            God, I do love California. $10,000,000,000 of the annual $100,000,000,000 state budget went to pay for people who aren't legally supposed to be in the state....with all of the crime they cause, and jails they fill up, try finding an open emergency room, most have closed due to illegals making them go bankrupt....and California is more upset about Jesse James building motorcycles that spend most of their time getting dusty. If these guys were smart, they would leave the state, and do it as publicly as possible.

                              The guy who builds his own bike or car doesn't get away with it. I'm glad they're going after high profile builders like Jesse James and Boyd Coddington.

                              I'm just glad I don't live there any more.
